Local Environmental Protection Program
SERVING: Clay, Cloud, Geary, Marshall, Morris, and Washington Counties
Overview
The Local Environmental Protection Program allows local entities to receive a state
environmental protection grant for development of an environmental protection
plan to implement the water quality strategy of the Kansas Water Plan.
County sanitary codes are part of the environmental protection plan that may regulate local activities including; private on-site wastewater system installation, private domestic
water supply well drilling, subdivision water and wastewater planning, solid
waste management, hazardous waste management, public water supply protection,
and non-point source pollution control.

On-site Wastewater Systems (septic tanks, absorption systems, lagoons, and alternative wastewater systems)
- All Rural Lakes Region counties require a permit for new construction and
major repairs to old systems.
- A site evaluation is conducted prior to construction and a final inspection is conducted after the construction is completed.
Private Water wells
- All Rural Lakes Region counties require a permit for new construction of private domestic water wells.
- A site evaluation is conducted prior to construction and a final inspection is conducted after the construction is completed.
Real Estate Inspections
- On-site wastewater systems (septic tanks, absorption systems, lagoons, and
alternative wastewater systems) inspections are conducted by request only (except in Geary County
where they are mandatory prior to the sale of a rural home).
- Water supply inspection is conducted by request only. This includes an assessment of the well and a water test.
Private well water testing
- Water samples are collected and analyzed by the environmental staff. We test for
Coliform bacteria, E.Coli bacteria, and Nitrates.
